1) Who we are

2) What these Terms cover

These Terms apply to your access to and use of the Site, our blog, contact forms, and any content we publish (collectively, the “Services” for website purposes). If you engage Artem for paid work, that engagement will be governed by a separate written agreement (e.g., proposal, statement of work, or MSA). If there is a conflict, the written agreement controls.

3) Privacy

Your use of the Site is also subject to our Privacy Policy, which explains what we collect and how we use it.

4) Acceptable use

You agree not to:

  • break the law or others’ rights;

  • attempt to access non-public areas or interfere with the Site;

  • copy, scrape, or mine the Site at scale;

  • upload malware or attempt to disrupt performance;

  • use the Site to send spam or misleading inquiries.

We may suspend or block access for any violation.

5) Intellectual property

All text, graphics, logos, photos, videos, and code on the Site are owned by Artem or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to view the Site for personal or internal business use. You may not reproduce, modify, or redistribute Site content without our written permission.
“Artem Worldwide” and our marks are trademarks of Artem.

6) Your content and inquiries

If you submit information through forms or email (e.g., a brief, portfolio, or feedback), you represent you have the right to share it and that it is accurate. Do not send confidential information unless we have signed an NDA. If you send unsolicited ideas without an NDA, you grant Artem a limited right to review and evaluate them.

7) Third-party services and links

The Site may link to third-party sites or tools (e.g., WhatsApp, analytics, embed players). We do not control those services and are not responsible for their content or policies. Your use of third-party services is at your own risk and may be subject to their terms.

8) Disclaimers

The Site is provided “as is” and “as available.” To the maximum extent permitted by law, Artem disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Site will be uninterrupted, secure, or error-free.

9) Limitation of liability

To the maximum extent permitted by law, Artem will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed USD $100.

10) Indemnification

You agree to defend, indemnify, and hold harmless Artem and our directors, employees, and contractors from any claims, damages, or costs arising from your use of the Site, your content, or your breach of these Terms.

11) DMCA / copyright complaints

If you believe content on the Site infringes your copyright, send a notice to hello@artemworldwide.com with:

  • your contact information;

  • identification of the work you claim is infringed;

  • the exact URL of the allegedly infringing material;

  • a statement under penalty of perjury that you have a good-faith belief the use is not authorized; and

  • your physical or electronic signature.
    We may remove content at our discretion and, when appropriate, notify the contributor.

12) Accessibility

We aim to make our Site accessible. If you experience issues, email hello@artemworldwide.com and we will try to help.

13) International use and export

The Site is controlled from the United States. You are responsible for compliance with local laws and any applicable export controls when accessing the Site outside the U.S.

14) Changes to the Site and Terms

We may update the Site and these Terms from time to time. When we do, we will change the “Last Updated” date. Your continued use of the Site after changes means you accept the updated Terms.

15) Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict of laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, California for any dispute related to the Site or these Terms.

16) Miscellaneous

If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the rest will remain in force. No waiver is effective unless in writing. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or sale of assets.
